Important update for Swiss companies expanding to or operating in the United States

On December 17, 2025, the International Trade Administration released a Notice confirming that key elements of the U.S.–Switzerland trade arrangement have now been formalized. A major component is the reduction of the reciprocal tariff rate from 39% to 15%, effective for goods entered for consumption beginning November 14, 2025.  This applies to both Switzerland and Liechtenstein.

Because the change is retroactive, companies that imported Swiss-origin goods since November 14 may be eligible for refunds via post-summary corrections or corrected entries.  

The Notice also clarifies:  

  • The 15% cap functions similarly to the EU/Japan deals 
  • Certain items listed in Annex I and Annex II may qualify for full exemption
  • Civil Aircraft Agreement–eligible goods may also be exempt
  • Several classifications continue to rely on existing exemptions due to missing CBP definitions (e.g., “not patented in the United States”)
